After old business was completed, motion by Monson, seconded by Klungseth to adjourn the meeting. Motion carried.
Attorney VanderLinden administered the oaths of office to Mike Grosek, elected Mayor, Jim Grimes, elected Councilman Ward I, Wally Pribyl appointed Councilman Ward II, and Roger Monson, elected Councilman Ward III. After taking the oaths of office, Mayor Mike Grosek called the meeting to order.
The Mayor called for nominations for President. Motion by Monson, seconded by Pribyl to nominate Morgan Dorsett and that nominations cease. All councilmen voting aye. Motion carried.
The Mayor called for nominations for Vice-President. Motion by Monson, seconded by Pribyl to nominate Jim Grimes and that nominations cease. All councilmen voting aye. Motion carried.

Petitions for Referendum of Resolution for Opt Out that was passed by the City Council on April 4, 2011, were presented. Motion by Monson, seconded by Grimes to vote on the Opt Out Resolution at a special election to be held on June 14, 2011. All councilmen voting aye. Motion carried.
Motion by Jesme, seconded by Dorsett to hire Deborah Finnesand as swim team coach at the rate of $2,000.00 for the season. All councilmen voting aye. Motion carried.
Discussion was held about property owners that have failed to remove diseased elm trees that were marked by the forester last year. City Hall will send out reminder letters and if trees are not removed in 30 days the City will hire the work done and assess the costs to the property owners.

Motion by Klungseth, seconded by Pribyl to approve Jennifer Wickre attend Finance Officers’ School June 8th – 10th in Pierre, and to pay the registration fee of $75.00. All councilmen voting aye. Motion carried.
The City has received the new rates for health insurance effective July 1st from the Health Pool of SD. The City will see a decrease in rates by 14% of last year’s premiums. The decrease is based on the three year average loss ratio and plan choice.
Motion by Monson, seconded by Klungseth to approve the following electrical and plumbing licenses for the term of May 1, 2011 through April 30, 2012: Larry Block, plumbing; Wayne Keller, plumbing and electrical; Wayne’s Heating, plumbing; Ridge Electric, electrical; Bierschbach Electric, electrical; and garbage license for R & S Sanitation for the term of July 1, 2011 through June 30, 2012. All councilmen voting aye. Motion carried.
Motion by Jesme, seconded by Grimes to set variance hearings for United Methodist Church, 105 East 9th Avenue, to place a storage building closer to the lot line than city ordinance allows, and for Loren Schoenbeck, 506 East 2nd Street, to build a garage larger than city ordinance allows and to side the structure with steel. The hearings are set for 7:10 p.m. on June 6, 2011, at City Hall. All councilmen voting aye. Motion carried.
The City is in receipt of a letter from Charles and Connie Bacon requesting the City to consider discharging an easement on property they own. Motion by Monson, seconded by Dorsett to have the city attorney notify Bacon’s that the city’s storm water goes through this drainage way and that the city plans to retain drainage rights. All councilmen voting aye. Motion carried.
Tom Sannes was present to discuss the upcoming special election. He informed the council that W.A.V.E. will hold public meetings and be sending out mailings in support of a new pool.
7:00 p.m. This being the time and place for the opening of sealed bids for a season’s supply of hot and cold mix. The following bids were received:

7:10 p.m. This being the time and place for a hearing to consider granting a special malt beverage license for the American Legion Post 40 for June 4th and 5th at the Veterans Memorial Sports Complex. Motion by Jesme, seconded by Pribyl to approve the license. All councilmen voting aye. Motion carried.
At the bid opening held on April 26th, three bids were received for the water meter replacement project. The bids are listed as follows:

Dakota Supply Group, Burnsville, MN $304,574.84
Clark Engineering reviewed all bids and found clarification that should be provided on the bid schedule and discrepancies with the proposed meter system from the low bidder as compared to the specification requirements, and have recommended the
City Council consider rejecting all bids. After discussion, motion by Dorsett, seconded by Monson to reject all of the bids. All councilmen voting aye. Motion carried. Motion by Pribyl, seconded by Jesme to approve advertising for bids again and open bids at 11:00 a.m. on June 1, 2011, at City Hall. All councilmen voting aye. Motion carried.
Mayor Grosek read a letter from SD Dept. of Environment and Natural Resources congratulating the City of Webster for outstanding wastewater system operations and compliance with its Surface Water Discharge permit.
Motion by Pribyl, seconded by Dorsett to approve the mayor signing the grant agreement with SD Dept. of Ag. The $1,000.00 grant will be used to purchase trees to plant on city properties. All councilmen voting aye. Motion carried.
Motion by Pribyl, seconded by Dorsett to declare the following list of items as surplus property and have these items appraised for sale: 125cc 4 wheeler ATV, 1990 Chevrolet ¾ Ton 2 wheel drive pickup, 1988 Kelvinator 220 volt AC, Quasar 220 volt A/C, 19” RCA TV, 19” Zenith TV, 10 ft. chain link rolling gate, 16 ft. 2 in. pipe gate, 1946 IHC tractor with broom A Model, pressure washer Electro Magic 7003S. All councilmen voting aye. Motion carried.
Motion by Monson, seconded by Grimes to approve the filing of the paperwork with Day County for the abatement of property taxes on the land the City purchased for the new lagoon. All councilmen voting aye. Motion carried.
Motion by Grimes, seconded by Monson to accept the fuel bid from Sioux Valley Co-op as follows: Unleaded gas $3.875, Diesel #2 $3.885. All councilmen voting aye. Motion carried.

Mayor and council discussed a meeting they attended at the Economic Development Office on April 18th regarding hiring a code enforcement officer for Day County. This would be a part-time position and the person hired would be responsible to enforce each community’s ordinances pertaining to nuisance offenses. The cost to the City of Webster would be $3,500.00 a year for an initial three year period. No action taken at this time.
Todd Garry was present to inform the council the Boy Scouts are planning to retire flags this weekend and to drop off flags at his office.
Motion by Monson, seconded by Dorsett to go into Executive session as set forth in SDCL 1-25-2 for the purpose of discussing personnel matters. Council convened into
Executive Session at 7:45 p.m. At 8:00 p.m. the council adjourned from Executive
Session with a motion by Dorsett, seconded by Pribyl. All councilmen voting aye. Motion carried.
No further business, motion by Jesme, seconded by Dorsett to adjourn. Motion carried. Next regular scheduled meeting is June 6, 2011, 6:30 p.m.
